Terms of Service

1. Acceptance of Terms

By accessing and using the IVVER mobile application and platform ("Service"), you accept and agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use our Service.

IVVER operates as a peer-to-peer vehicle rental marketplace platform connecting vehicle owners ("Owners") with renters ("Renters") in Morocco for cars, motorcycles, and other vehicles.

2. Eligibility

To use IVVER, you must:

  • Be at least 21 years old for car rentals and 18 years old for motorcycle rentals
  • Hold a valid driver's license appropriate for the vehicle category
  • Provide accurate and complete registration information
  • Have the legal capacity to enter into binding contracts
  • Not be prohibited from using the Service under Moroccan law

3. User Accounts

3.1 Account Registration

You must create an account to access certain features. You agree to:

  • Provide accurate, current, and complete information
  • Maintain and update your information to keep it accurate
  • Maintain the security of your account credentials
  • Notify us immediately of any unauthorized use

3.2 Account Verification

IVVER may require identity verification, driver's license validation, and other documentation. Failure to provide requested verification may result in account suspension or termination.

4. For Vehicle Owners

4.1 Listing Requirements

As a vehicle Owner, you must:

  • Own or have legal authority to rent the listed vehicle
  • Ensure the vehicle meets all Moroccan safety and legal requirements
  • Maintain valid vehicle registration (Carte grise)
  • Maintain comprehensive insurance coverage
  • Provide accurate vehicle information, photos, and pricing
  • Disclose any known defects or issues with the vehicle

4.2 Owner Responsibilities

Owners are responsible for:

  • Vehicle maintenance and roadworthiness
  • Technical inspection (Visite technique) validity
  • Proper handover and return inspection
  • Setting appropriate rental rates and availability
  • Responding to booking requests within 24 hours

4.3 Prohibited Vehicles

You may not list vehicles that are:

  • Stolen, salvaged, or have undisclosed liens
  • Not properly registered or insured
  • Modified in ways that void manufacturer warranties or violate regulations
  • Unsafe or not roadworthy

5. For Renters

5.1 Booking and Payment

As a Renter, you agree to:

  • Provide accurate booking information
  • Pay the agreed rental fee and any applicable charges
  • Present valid identification and driver's license at pickup
  • Inspect the vehicle before accepting it

5.2 Vehicle Use

Renters must:

  • Operate the vehicle safely and in accordance with Moroccan traffic laws
  • Not use the vehicle for illegal purposes or commercial use (unless agreed)
  • Not sublet or lend the vehicle to third parties
  • Not drive outside Morocco without explicit Owner permission
  • Not drive under the influence of alcohol or drugs
  • Return the vehicle on time and in the same condition

5.3 Prohibited Uses

Renters may not:

  • Use the vehicle for racing, rallying, or off-road activities (unless vehicle is designated for such use)
  • Transport illegal goods or substances
  • Exceed the vehicle's passenger or weight capacity
  • Smoke in non-smoking vehicles
  • Transport animals without prior approval

6. Fees and Payments

6.1 Platform Fee

IVVER charges a service fee for facilitating rentals. The fee structure is clearly displayed before booking confirmation.

6.2 Payment Processing

All payments are processed securely through our payment partners. IVVER does not store complete payment card information.

6.3 Cancellation and Refunds

Cancellation policies vary by listing. Owners set their own cancellation terms, which are displayed before booking. IVVER's cancellation fee may apply.

6.4 Security Deposit

A refundable security deposit may be required. The deposit is held and released according to the terms agreed between Owner and Renter, minus any deductions for damages.

7. Insurance and Liability

7.1 Required Insurance

All vehicles must maintain valid insurance as required by Moroccan law. IVVER does not provide insurance coverage. Owners and Renters are responsible for ensuring adequate coverage.

7.2 Damage and Loss

Renters are liable for any damage to the vehicle during the rental period, except for normal wear and tear. Renters must report all accidents and incidents immediately.

7.3 Limitation of Liability

IVVER acts solely as a marketplace platform connecting Owners and Renters. We are not a party to the rental transaction and are not liable for:

  • Vehicle condition, safety, or roadworthiness
  • Accuracy of vehicle listings
  • Conduct of Owners or Renters
  • Property damage or personal injury arising from vehicle use
  • Any disputes between Owners and Renters

8. Dispute Resolution

8.1 User Disputes

Disputes between Owners and Renters should first be resolved directly. IVVER may provide mediation services but is not obligated to do so.

8.2 Platform Disputes

Disputes with IVVER shall be governed by Moroccan law and subject to the jurisdiction of Moroccan courts.

9. Prohibited Conduct

Users may not:

  • Violate any laws or regulations
  • Infringe on intellectual property rights
  • Engage in fraudulent or deceptive practices
  • Harass, abuse, or harm other users
  • Interfere with platform operations
  • Attempt to circumvent the platform to avoid fees
  • Create multiple accounts to manipulate ratings or reviews
  • Use automated tools to scrape or access the platform

10. Content and Reviews

10.1 User Content

You retain ownership of content you post but grant IVVER a license to use, display, and distribute it on the platform.

10.2 Reviews and Ratings

Reviews must be honest, factual, and based on actual experiences. IVVER reserves the right to remove reviews that violate our content policy.

11. Termination

IVVER may suspend or terminate your account at any time for:

  • Violation of these Terms
  • Fraudulent or illegal activity
  • Providing false information
  • Failure to pay fees owed
  • Harming the platform or other users

Upon termination, all pending bookings may be cancelled, and you forfeit any credits or balances.

12. Intellectual Property

The IVVER name, logo, and all platform content are protected by intellectual property rights. You may not use our trademarks or copyrighted material without permission.

13. Modifications to Terms

IVVER reserves the right to modify these Terms at any time. We will notify users of material changes. Continued use of the Service constitutes acceptance of modified Terms.

14. Data Protection

Our collection and use of personal information is governed by our Privacy Policy, which is incorporated into these Terms.

16. Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.

17. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and IVVER regarding use of the Service.
