Terms of Service

1. Purpose and Scope
These Terms of Service (hereinafter the "Terms") define the conditions of access to and use of the IVVER mobile application and related services (hereinafter the "Service"), published by IVVER (hereinafter the "Publisher").
IVVER operates a digital marketplace enabling:
- service providers (individuals or professionals, hereinafter "Providers") to offer goods or services for rental or booking;
- users (hereinafter "Renters") to search for, consult, and book such goods or services.
The platform may, in due course, offer additional categories of services, including accommodation rental and activity booking.
2. Acceptance of Terms
Access to and use of the Service are conditional upon prior and unreserved acceptance of these Terms. The User acknowledges having read and understood the Terms prior to any use of the Service.
The creation of a user account constitutes full and unconditional acceptance of these Terms. In the event of disagreement with all or part of the stipulations herein, the User is invited not to use the Service.
3. Access and Eligibility
3.1 Eligibility
Access to the transactional functionalities of the Service as a Renter is subject to the following cumulative conditions:
- Being at least eighteen (18) years of age.
- Holding a valid driving licence recognised in the country where the service is used.
- Having a valid payment method for the purposes of the deposit and/or payment of the price.
Specific eligibility conditions may apply depending on the category of service concerned.
3.2 User Account
Registration is mandatory to access the transactional functionalities of the Service. The User is responsible for maintaining the confidentiality of their login credentials and for all activities carried out under their account. The User undertakes to provide accurate, complete, and up-to-date information.
4. Operation of the Service
4.1 Booking and Contractual Relationship
IVVER acts exclusively as a technical intermediary. The service contract (including any rental agreement) is concluded directly between the Provider and the Renter. IVVER is not a party to the service contract and does not assume any of the obligations incumbent upon the contracting parties.
4.2 Identity Verification
The Renter consents to provide their identity documents (driving licence, national identity card) through the application. Such documents are transmitted to the relevant Provider solely for the purposes of establishing the contractual relationship, in accordance with the Privacy Policy.
4.3 Cancellation
Cancellation of a booking is free of charge when effected at least twenty-four (24) hours before the scheduled commencement of the service. Beyond this period, cancellation fees may apply in accordance with the conditions communicated at the time of booking.
5. Responsibilities
5.1 Renter's Responsibility
The Renter is responsible for the rented asset for the entire duration of the service. In this capacity, the Renter undertakes to:
- use the asset in a reasonable and prudent manner, in accordance with its intended purpose;
- comply with all applicable legal and regulatory provisions, including traffic regulations;
- return the asset in the condition in which it was received, subject to normal wear and tear.
In the event of damage, accident, or theft, the Renter shall be liable, save in cases of force majeure within the meaning of Section 12 hereof or a duly established pre-existing defect.
5.2 Provider's Responsibility
The Provider undertakes to provide an asset in good working order, consistent with the description published on the platform, duly insured, and complying with all applicable legal obligations (including up-to-date technical inspection and valid administrative documents).
5.3 Limitation of Publisher's Liability
The Publisher, in its capacity as technical intermediary, shall not be held liable for:
- the condition, conformity, or availability of assets offered by Providers;
- the conduct, acts, or omissions of Users (Renters or Providers);
- disputes arising between the parties in connection with the service (damages, fines, claims).
The Publisher's liability shall not be engaged beyond the limits provided for by applicable law.
6. Payments and Deposits
Payment operations and bank card imprints for deposits are processed by a duly authorised third-party payment provider. IVVER facilitates the transaction as an intermediary but does not hold funds on a permanent basis. Complete bank card data is not stored on IVVER's servers.
7. User-Generated Content
Users may publish content on the platform (including photographs, descriptions, and reviews). The User warrants that they hold all necessary intellectual property rights over the content they publish and grants IVVER a non-exclusive, worldwide, royalty-free licence to use such content for the purposes of operating the Service.
The built-in Messaging Feature is strictly reserved for exchanges relating to services offered on the platform. IVVER reserves the right to moderate, suspend, or remove any content or account in the event of a breach of these Terms, including abusive behaviour, harassment, fraud, or the dissemination of unlawful content.
8. Intellectual Property
All elements constituting the Service (including the IVVER brand, logos, graphic interface, texts, software, and databases) are protected by applicable intellectual property legislation and remain the exclusive property of the Publisher or its licensors.
Any unauthorised reproduction, representation, modification, or exploitation of these elements, in whole or in part, is prohibited and may constitute infringement under applicable law.
9. Suspension and Termination
The Publisher reserves the right to suspend or terminate, as of right and without prior notice, any User's access to the Service in the event of:
- breach of these Terms;
- provision of inaccurate, incomplete, or fraudulent information;
- conduct prejudicial to the security, integrity, or reputation of the Service or its Users;
- a request from a competent authority.
The User may terminate their account at any time by deleting it in the application settings. The effects of termination on personal data are described in the Privacy Policy.
10. Personal Data
IVVER collects and processes personal data in accordance with Moroccan Law No. 09-08 and Regulation (EU) 2016/679 (GDPR) where applicable. For further details, the User is invited to consult the Privacy Policy.
11. Amendment of Terms
The Publisher reserves the right to amend these Terms at any time. Users shall be informed of any material amendment by means of a notification within the application or by electronic communication. The date of the most recent update is indicated at the head of these Terms.
Continued use of the Service following notification of an amendment shall constitute acceptance of the revised Terms. Users who do not agree with the amendments are invited to discontinue use of the Service and to delete their account.
12. Force Majeure
Neither party shall be held liable for any failure to perform or delay in performance of its obligations hereunder, where such failure or delay results from an event of force majeure within the meaning of applicable law, including natural disasters, armed conflicts, generalised telecommunications network failures, epidemics, or any governmental or regulatory decision preventing performance of obligations.
13. Severability
In the event that any provision of these Terms is declared null, illegal, or unenforceable by a court of competent jurisdiction, the remaining provisions shall continue in full force and effect. The invalidated provision shall be replaced by a valid provision that most closely reflects the parties' original intent.
14. Governing Law and Jurisdiction
These Terms shall be governed by and construed in accordance with Moroccan law.
In the event of a dispute relating to the interpretation, performance, or termination of these Terms, the parties shall endeavour to reach an amicable resolution. Failing amicable resolution within thirty (30) days, the dispute shall be submitted to the competent courts in accordance with applicable rules of territorial jurisdiction.
